Terms of Service

These Terms of Service ("Terms") govern your use of the Gratitude Performance Tracker mobile application ("the App", "Service") operated by Gratitude Performance Tracker ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree to these Terms, you must not use the App.
2. Account Registration
To use certain features of the App, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised use of your account
- Accept responsibility for all activities that occur under your account
3. Subscriptions & Payments
The App offers both free and premium subscription tiers.
- Subscriptions are billed through the Google Play Store
- Payment is charged to your Google Play account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage or cancel your subscription through Google Play Store settings
- Refunds are handled according to Google Play Store's refund policy
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Share content that is abusive, harassing, threatening, or hateful
- Attempt to gain unauthorised access to other users' accounts or data
- Upload malicious code, viruses, or harmful content
- Use the App to spam or send unsolicited messages
- Reverse engineer, decompile, or disassemble the App
- Use automated systems or bots to access the App
5. User Content
You retain ownership of all content you create within the App, including journal entries, reflections, photos, and other personal data. By using the social features to share content, you grant us a limited licence to display that content to the users you have chosen to share with.
We do not claim ownership of your content. You are solely responsible for the content you create and share.
6. Health & Wellness Disclaimer
The App provides tools for tracking health and wellness metrics such as sleep, hydration, nutrition, period cycles, and fitness activities. This information is for personal tracking purposes only and:
- Is not medical advice — the App is not a substitute for professional medical advice, diagnosis, or treatment
- Should not be relied upon for medical decisions — always consult a qualified healthcare provider
- May not be accurate — nutritional information from barcode scanning is sourced from third-party databases and may contain errors
7. Intellectual Property
The App, including its design, code, graphics, logo, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our written permission.
8. Service Availability
We strive to keep the App available at all times but do not guarantee uninterrupted access. We may:
- Temporarily suspend the App for maintenance or updates
- Modify or discontinue features with reasonable notice
- Terminate or suspend your account for violation of these Terms
9. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.
11. Termination
You may stop using the App and delete your account at any time. We may terminate or suspend your access if you violate these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation or, if necessary, through the courts of the applicable jurisdiction.
